The rules governing PolarPaw.Online, P.O.L.A.R., customer access, and ETSA™.

Terms of Use

1. Agreement to these terms

These Terms of Use are a binding agreement between you and BI POLARIZE ENTERPRISES, INC. (“BPEI,” “we,” “us,” or “our”) governing PolarPaw.Online and its public and authenticated online systems, including P.O.L.A.R., customer accounts, the customer portal, Identify Your Thing™, and ETSA™. By accessing or using these systems, you accept these Terms and our Privacy Policy. If you do not agree, do not use them.

2. Eligibility and authority

You must be at least 18 years old to create an account, submit an intake, take ETSA, or purchase services unless BPEI has documented authorization from a parent, guardian, school, or other legally authorized sponsor. If you act for a business or another person, you represent that you have authority to bind that party and submit its information.

3. Website purpose; no automatic engagement

The site provides information about BPEI, its services, divisions, systems, and intake pathways. Public content is informational. Submitting an inquiry, account registration, assessment, intake, message, payment, or document does not by itself create a client relationship, partnership, fiduciary duty, employment relationship, or obligation to accept or perform work. A client engagement begins only under written terms accepted by BPEI and the client.

4. Accounts and security

You must provide accurate information, keep credentials and recovery tokens confidential, use only accounts you are authorized to use, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your credentials to the extent permitted by law. We may suspend or restrict access when reasonably necessary to protect users, data, or systems.

5. Your submissions

You retain ownership of materials you submit. You grant BPEI a limited, nonexclusive license to host, store, copy, analyze, transform, and use those materials only as reasonably necessary to operate the requested system, evaluate an inquiry, generate outputs, communicate with you, protect the platform, comply with law, and perform an accepted engagement. You represent that you have the right to submit the materials and that they are accurate, lawfully obtained, and do not violate another person’s rights.

6. P.O.L.A.R., ETSA, and AI-assisted outputs

P.O.L.A.R. and ETSA may produce analyses, scores, talent profiles, readiness classifications, drafts, summaries, risk flags, contradiction flags, recommendations, and routing decisions. These outputs may contain errors, incomplete assumptions, or uncertainty and must be reviewed in context. ETSA does not make autonomous final employment decisions. No AI-assisted output is legal, tax, accounting, medical, lending, investment, regulatory, or other licensed professional advice, and no particular business, funding, hiring, revenue, compliance, or market outcome is guaranteed.

7. Services, pricing, payment, and refunds

Service descriptions and starting prices on the site are invitations to inquire, not automatic fixed quotes. Scope, fees, deposits, timelines, deliverables, revisions, cancellation, refund eligibility, acceptance, intellectual-property rights, and other project obligations are governed by the applicable proposal, invoice, statement of work, master service agreement, checkout terms, or other written agreement. If these Terms conflict with a signed engagement agreement, that agreement controls for the engagement.

8. Acceptable use

You may not use the site to violate law or rights; submit malicious, deceptive, infringing, or unlawfully obtained material; impersonate another person; harass or exploit anyone; probe or bypass security; access another user’s data; scrape protected content; overload or disrupt systems; reverse engineer restricted components except where law expressly permits; introduce malware; automate abusive requests; or use outputs to make unlawful discriminatory or fully automated high-impact decisions.

9. Intellectual property

Except for user submissions and identified third-party material, the site, P.O.L.A.R. and ETSA systems, BI POLARIZE branding, division identities, designs, text, graphics, audiovisual works, software, scoring logic, architecture, methods, and trademarks are owned by or licensed to BPEI and protected by law. No license is granted except the limited right to use the site as these Terms allow. “BI POLARIZE,” “P.O.L.A.R.,” “Tell Us About Your Thing™,” “Identify Your Thing™,” “ETSA™,” “Bipolarized Blueprint™,” and associated marks and content may not be used in a manner suggesting endorsement or ownership without written permission.

10. Third-party services and links

The site may use or link to hosting, authentication, analytics, payment, review, social-media, or other third-party services. Their own terms and privacy policies apply to your direct interaction with them. BPEI does not control third-party content, availability, or independent data practices.

11. Availability, changes, and termination

We may update, restrict, suspend, or discontinue features; impose reasonable limits; correct errors; and revise these Terms as the platform evolves. We do not guarantee uninterrupted availability. We may terminate or suspend access for a material violation, security risk, unlawful activity, nonpayment under an applicable agreement, or conduct that threatens BPEI, users, or systems. Provisions that by nature should survive termination will survive.

12. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PUBLIC SITE AND SELF-SERVICE DIGITAL FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BPEI DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NOTHING HERE EXCLUDES A WARRANTY THAT CANNOT LEGALLY BE EXCLUDED.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BPEI AND ITS DIRECTORS, OFFICERS, PERSONNEL, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM THE PUBLIC SITE OR SELF-SERVICE FEATURES. BPEI’S AGGREGATE LIABILITY ARISING ONLY FROM USE OF THE PUBLIC SITE WILL NOT EXCEED $100. LIABILITY FOR A PAID ENGAGEMENT IS GOVERNED BY THE CONTROLLING WRITTEN AGREEMENT. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.

14. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless BPEI and its directors, officers, personnel, contractors, and providers from third-party claims, damages, and reasonable costs arising from your unlawful use of the site, violation of these Terms, or submission of material you had no right to provide. This obligation does not apply to the extent a claim results from BPEI’s own unlawful conduct.

15. Governing law and venue

Utah law governs these Terms, without regard to conflict-of-law rules. Any dispute not governed by a separate written agreement must be brought exclusively in a state or federal court with jurisdiction in Weber County, Utah, and each party consents to that venue, except where applicable consumer law requires otherwise.

16. General terms

These Terms and the Privacy Policy form the entire agreement concerning use of the site, except for separate written engagement terms. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; BPEI may assign them in connection with a merger, reorganization, financing, or transfer of the platform or business. Headings are for convenience only.
